Dr. Octopus Personal User Registration Terms & Privacy Agreement

Effective Date: September 28, 2026

By creating a Personal User account on Dr. Octopus ("Dr. Octopus", "we", "us", or "our"), you ("User", "Customer", "you", or "your") acknowledge that you have read, understood, and agree to this Personal User Registration Terms & Privacy Agreement.

Your registration will not be completed unless you select "I Agree & Register".

1. Registration Required for Certain Features

Certain Dr. Octopus features are available only to registered users.

Unless otherwise expressly stated by Dr. Octopus, you must create and maintain a registered account in order to access certain marketplace benefits, including:

- User-only discounts and offers;
- Posting projects or service requests;
- Requesting quotations;
- Receiving quotations;
- Communicating with eligible Businesses through the platform;
- Accessing certain marketplace features.

Creating an account does not guarantee that a particular discount, quotation, Business, price, or service will be available.

2. User Information

You agree to provide accurate and current information when creating an account.

Depending on how you use Dr. Octopus, we may collect:

- Name;
- Email;
- Telephone number;
- Address or service location;
- Account information;
- Project information;
- Photos and videos;
- Documents;
- Budget and timeline;
- Communications;
- Reviews and ratings;
- Technical and usage information.

3. Posting a Project or Service Request

You may use Dr. Octopus to submit a project, service request, quotation request, or other inquiry.

You understand that Dr. Octopus is a marketplace designed to connect your request with eligible Businesses and Professionals.

4. Sharing Your Project Information

By submitting a project or service request, you expressly authorize Dr. Octopus to share the relevant information contained in your request with eligible Businesses and Professionals for the purpose of:

- Evaluating your project;
- Providing quotations;
- Submitting proposals;
- Offering services;
- Communicating with you regarding the project.

Depending on the nature of the request, the information shared may include:

- Your project description;
- Requested service;
- Location or service area;
- Budget;
- Timeline;
- Photos;
- Videos;
- Documents;
- Other information you voluntarily provide.

You acknowledge that the same project may be made available to multiple eligible Businesses.

This sharing of information is a fundamental part of the Dr. Octopus marketplace.

5. Important Information Before Posting

You should not include highly sensitive personal information, passwords, banking credentials, government identification numbers, or other information that is not necessary to describe your project.

You are responsible for reviewing the information you submit before publishing a project request.

6. Quotations

Businesses may submit quotations, proposals, estimates, or offers in response to your project.

A quotation is provided by the relevant Business and is not a guarantee by Dr. Octopus.

You should independently review important details before accepting a quotation, including:

- Price;
- Scope of work;
- Materials;
- Timeline;
- Payment terms;
- Warranty;
- Cancellation terms;
- Licences;
- Insurance;
- Contract terms.

Any agreement for goods or services is generally between you and the selected Business.

7. Business Profiles, Reviews and Ratings

Dr. Octopus may display Business profiles, reviews, ratings, scores, comments, and other marketplace information to registered users.

By using the platform, you acknowledge that Business reviews and ratings may be visible to users and prospective customers.

You may be invited to submit reviews and ratings based on your genuine experience.

Reviews must be truthful and must not contain knowingly false, fraudulent, threatening, discriminatory, or unlawful content.

Dr. Octopus may moderate or remove reviews that violate applicable policies or law.

8. Discounts and Offers

Certain discounts, promotions, and offers may only be available to registered Dr. Octopus users.

The specific terms of each offer are determined by the Business providing the offer.

Offers may be subject to:

- Expiration dates;
- Minimum purchases;
- Service restrictions;
- Geographic restrictions;
- Availability;
- Promotional codes;
- Other stated conditions.

A Business is responsible for the accuracy of its own prices and promotional representations.

9. Business Responsibility

Businesses listed on Dr. Octopus are independent service providers.

Dr. Octopus does not guarantee:

- The quality of a Business's services;
- The accuracy of a Business's representations;
- The final price;
- The availability of a Business;
- The outcome of a project;
- The performance of a Business;
- That a particular Business will accept your project.

You should independently verify important information before entering into a contract.

10. Privacy and Use of Information

Dr. Octopus may collect, use, store, and disclose your information for purposes including:

- Operating the marketplace;
- Creating and maintaining your account;
- Matching you with relevant Businesses;
- Sharing project requests with eligible Businesses;
- Facilitating quotations and communications;
- Processing transactions where applicable;
- Providing customer support;
- Improving the platform;
- Preventing fraud and abuse;
- Maintaining security;
- Complying with applicable laws.

Your information will be handled in accordance with applicable Canadian privacy legislation and the Dr. Octopus Privacy Policy.

11. Communication

Dr. Octopus and Businesses may contact you regarding:

- Your account;
- Your project;
- Quotations;
- Offers;
- Customer service;
- Transactions;
- Marketplace activity;
- Security;
- Platform-related matters.

Commercial promotional communications will be handled in accordance with applicable law, including CASL where applicable.

12. User Responsibilities

You agree not to:

- Provide false information;
- Submit fraudulent projects;
- Misuse quotation requests;
- Manipulate reviews or ratings;
- Harass Businesses;
- Request unlawful services;
- Attempt to obtain confidential information;
- Misuse information obtained through Dr. Octopus;
- Create fraudulent accounts;
- Use the platform for unlawful or deceptive activities.

13. Disputes With Businesses

If you enter into a transaction or service agreement with a Business, that agreement is generally between you and the Business.

Dr. Octopus may assist with marketplace-related issues where appropriate, but does not automatically become a party to the agreement.

Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable Canadian or provincial law.

14. Account Suspension or Termination

Dr. Octopus may suspend, restrict, or terminate an account where reasonably necessary to protect the platform, users, Businesses, or the integrity of the marketplace, including in cases involving fraud, abuse, unlawful activity, security risks, or violation of these Terms.

15. Limitation of Responsibility

To the maximum extent permitted by applicable law, Dr. Octopus is not responsible for losses arising directly from the independent conduct, services, quotations, contracts, prices, or performance of Businesses.

Nothing in this Agreement excludes or limits rights or liability that cannot legally be excluded or limited.

16. Changes

Dr. Octopus may update these Terms from time to time.

Where required by applicable law, appropriate notice will be provided regarding material changes.

17. Governing Law

Unless otherwise required by applicable law, this Agreement is governed by the laws of the Province of Ontario and applicable federal laws of Canada.

18. Acceptance

By selecting:

1. You have read and understood this Agreement;
2. The information you provide is accurate;
3. You understand that registration is required for certain Dr. Octopus marketplace features and user-only offers;
4. You authorize Dr. Octopus to share information contained in your project or service request with eligible Businesses and Professionals for the purpose of receiving quotations, proposals, and service offers;
5. You understand that multiple eligible Businesses may receive access to your project request;
6. You understand that Business profiles, reviews, and ratings may be displayed to registered users;
7. You agree to comply with these Terms and applicable law.
